Lambert Avocat Inc. of Quebec is filing a class-action lawsuit against Nintendo. It claims that Nintendo is knowingly selling a product, Joy-Cons, that are defective. The Joy-Con drift is a reported issue that has been reported since the initial release of Switch, back in 2017, and continues today. The selling of defective hardware violates the Consumer Protection Act.
This lawsuit is one of several filed against Nintendo for the drift issue. The first was filed in 2019 and since then, Nintendo has offered free repairs for the Joy-Cons. Despite their supposed issue to fix the drifting issue, Nintendo has continued to sell Nintendo Switches, Joy-Con, and Switch Lites with drifting. Because of this, many customers have either fixed the issue themselves or bought themselves a new pair.
